Canada Citizenship Application

There are two ways to Citizenship in Canada:

• One is by birth that is being born on Canadian land, airspace, waters and Canadian registered Ships and aircrafts even if the parents are neither PR of citizen of Canada or even if they don’t have any legal status in Canada.
• Citizenship is also allowed to all those born outside Canada if their Canadian citizen were employed outside by Canadian government and to those who are born outside Canada only if one parent was born or naturalized in Canada.

Other is through naturalization:

• Canadians with 3 years (1095 days) of qualifying permanent resident status during the preceding 5 years may apply for Canadian citizenship.
• ​​The applicant should be 18 year of age and must hold a PR status and if applying for children under 18 one parent must be a citizen or applying for Canada citizenship application at the same time.
• Have met any applicable requirement under the Income Tax Act to file income taxes for any three taxation years that are fully or partially within the five years immediately before you apply.

If between18-54 then must meet:

• The language requirements CLB 4 (in EILTS-G, CELPIP-G, TEF).
• Pass citizenship test, will also have second opportunity to pass.
• Take Oath of citizenship.

Time in prison/parole/probation does not count toward citizenship

Can’t be granted Canada citizenship if:

• PR requirements not met, if due to fraud or misrepresentation the status is in doubt or investigation is on.
• Canada Citizenship application was refused under misrepresentation in the last 5 years.
• Citizenship was taken away due to some fraud in last 10 years.
• Charged/convicted/trail or on appeal under citizenship Act (committed in 4 years before applying) Or with indictable offence inside or outside Canada Or any crime against humanity.

Language requirements can also be met with Diploma or transcripts showing secondary or post-secondary education in English or French Or Results from a government funded language course showing CLB 4 or NCLC 4 or higher Or in case of Individuals who underwent language testing in the process of applying for permanent residence can use those results as evidence of proficiency, even if they have since expired.

Processing of Canada Citizenship Application

Applications are submitted to the citizenship office in Sydney, Nova Scotia where they are pre-screened to ensure the application is complete and the 3-year residence rule has been met.

It takes almost 12 month to complete the process and applicants are called to attend an interview to demonstrate their knowledge of Canada in one of Canada’ Official languages.

If refused, the applicant is allowed to file an appeal to the Federal Court within 30 days of receipt of the decision from Citizenship court.
